Do I need Title Insurance on my home purchase?An owner’s Policy of Title Insurance protects the buyer against loss for title threats undiscovered at the time of closing and provides a defense in the event of claims against the title pursuant to the terms of the policy. Did you know that if you lose title to the land, you may still be responsible for paying the debt due your lender? Did you know that if a claim is paid on the Loan Policy, you may be responsible for reimbursing the title insurer for the claim paid to the lender? Think about building equity in your land over the years only to lose it to a title claim because you did not purchase an Owner’s Policy of title insurance! If you want title insurance protection for your interest in the land, you must buy your own Owner’s Policy.

As a Buyer, Can I Hire My Own Title Insurance Agent or Do I Have to Use the One My Attorney Has?Absolutely! You have a choice when selecting a title representative to handle the closing of your home. N. Y. Ins. Law § 2502(a)(2) (McKinney 2000) prohibits banks, trust companies, savings banks, savings and loan associations and national banks from requiring a borrower to obtain title insurance, from a specific title agent or insurer as a condition to, among other things, securing a mortgage commitment. While N. Y. Ins. Law § 2502(a)(2) (McKinney 2000) does not specifically address other mortgage lenders or their attorneys, N.Y. Banking Law § 595-a(4) (2001) prohibits a mortgage banker or a mortgage broker from requiring a borrower to purchase title insurance from a specific title company, agency or agent as a condition for securing a mortgage commitment.
